These Terms of Service ("Terms") govern your access to and use of ITM Leads ("we", "us"), including our website, order forms, and delivered data files (collectively, the "Services").
1. Eligibility & Accounts
You must be at least 18 years old and legally able to enter into contracts to use the Services. You are responsible for keeping your contact information accurate.
2. Orders & Payment
Productized packages are billed one-time via our payment processor (Stripe). Custom-quote projects are billed after you approve a fixed-price scope. All prices are in US dollars unless stated otherwise.
3. Delivery
Estimated delivery windows are displayed at checkout. We deliver data files by email to the address you provide. Delivery is deemed complete when we send the file.
4. Data Quality Guarantee
We target under 5% invalid rows across any list. If a delivered file exceeds this threshold, we will re-run the affected rows or refund the pro-rata amount per our Refund Policy.
5. Acceptable Use
You agree to comply with our Responsible-Use Policy, including all applicable anti-spam, privacy, and telemarketing laws in the jurisdictions where you and your prospects are located (including but not limited to GDPR, CCPA, CAN-SPAM, TCPA).
6. License to Data
Data files are licensed to you (the paying customer) for internal outbound outreach and CRM use. You may not resell, sublicense, or publicly redistribute the data.
7. Warranties & Disclaimers
Data is provided "as is". We make no warranties beyond the data-quality guarantee stated above. Business outcomes (conversion, revenue) are not guaranteed and depend on your outreach.
8. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising from the Services is limited to the amount you paid for the specific order that gave rise to the claim.
9. Termination
We may suspend or terminate service to any user who violates these Terms or our Responsible-Use Policy.
10. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles.
11. Changes
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page.
